Sec. 1. This Act shall be known and may be cited as the "Illinois FinancialAssistance Act for Nonpublic Institutions of Higher Learning".

Sec. 2. As used in this Act, unless the context otherwise requires:

(a) "Board" means the Board of Higher Education.

(b) "Enrollment" or "student" means the establishment and maintenance ofan individual's status as a student or enrollee in a nonpublic institutionof higher learning, regardless of the terms used at the institution todescribe such status.

(c) "Institution of higher learning", "qualified institution" or"institution" means a nonpublicly supported educational organizationlocated in this State which (1) provides a minimum of an organized 2-yearprogram of collegiate grade in the liberal arts or sciences directlyapplicable to the attainment of a baccalaureate degree, and (2) operatesprivately, not-for-profit and in conformity with standards substantiallyequivalent to those of the State-supported institutions of higher learning."Institution" does not include any educational organization used forsectarian instruction, as a place of religious teaching or worship or forany religious denomination or the training of ministers, priests, rabbis orother professional persons in the field of religion.

(d) "Academic year" means the period of time from September 1 of anyyear through August 31 of the ensuing year.

Sec. 3. For the academic year beginning in 2002,institutionalgrants may be made for that and for each succeeding academic yearto eachnonpublic institution of higher learning in an amount determined by allocatingamounts for funding this Act among the eligible institutions in accordancewith a formula or formulae basedupon one or more of the following factors: the number ofundergraduate degrees granted to students who are residents of theState of Illinois enrolled as students at each such institution; the numberoffull-time equivalent undergraduatestudents who are residents of the State of Illinois enrolled as studentsat each such institution; and the number of full-timeequivalent of such students who are junior or senior students at suchinstitutions. The Board of Higher Education shall establish formula allocations and adoptrules necessary for the administration of this Act.

Conditions of institutional eligibility for these grants shallinclude but need not be limited to the following:

(1) That the governing board of the institution possess its ownsovereignty.

(2) That the governing board, or its delegated institutionalofficials, possess final authority in all matters of local control,including educational policy, choice of personnel, determination ofprogram, and financial management.

(3) That the institution possess and maintain an open policy withrespect to race, creed and color as to admission of students,appointment of faculty and employment of staff.

(4) That the institution be able to show its current financialstability and reasonable prospects for its future stability.

(5) That the institution not be operated for profit.

(6) That the institution provide a full financial report including acertified audit, and participate in the unit cost study and otherstudies conducted annually by the Board of Higher Education.

(7) If required by rule of the Board, that the institution submit toan additional annual external audit of its enrollment records andnonsectarian use of funds.

Sec. 4. For the academic year beginning in 2002 and eachacademic year thereafter,each eligible institution of higher learning shall prepare and certify to theBoardin writing any information required by the Board to justify the grants. Thisinformation shall be signed andfurnished to the Boardby the chief administrative officer of the institution.

(110 ILCS 210/5) (from Ch. 144, par. 1335)

Sec. 5. The Board shall prescribe and advise such institutions as to the form ofcertificate or certificates to be submitted under Section 4 of this Act,and promptly uponreceipt of such certificates from the institutions shall certify to theState Comptroller the aggregate amount of the grant allocableto and to bepaid to each such institution. The Board shall examine the certificatesfurnished by the institutions and may require such further data andinformation as the Board may request. Upon written notice by the Board toany institution, the Board may examine the institution's student enrollmentrecords for the purpose of verification, amendment or correction of anysuch certificate.

(110 ILCS 210/6) (from Ch. 144, par. 1336)

Sec. 6. The Board of Higher Education may make awards to any nonpublicinstitution of higher learning and/or nonpublic institutions in consortiumand/or nonpublic institutions and public institutions in cooperation, forspecial services, programs needed, or for the performance of other tasks tomeet the State's higher education needs. Such services, programs, or tasksshall include, but not be limited to, computer resources, educationaltelevision and other instructional resources, all academic disciplines,academic and administrative organizational structures, and the maintenanceof existing programs and development of new programs designed to encourageenrollment of transfer students from private junior colleges and publiccommunity colleges.

Sec. 7. The Board shall keep an accurate record of all its activities under thisAct and shall make a reportto its members, to the Governor and to the General Assembly, suchreport to be a part of its annual report.

(110 ILCS 210/8) (from Ch. 144, par. 1338)

Sec. 8. If any provision of this Act is declared invalid for any reason, suchinvalidity shall not affect or impair any of the remaining provisions ofthe Act which can be given effect without the invalid provision, and tothis end, the provisions of this Act are declared to be severable.
